How do I register as an employer?


As an employer - whether a company, sole proprietor, partnership, association or other - you must register with EPF, SOCSO, LHDN, and - for employers with at least 10 full-time Malaysian employees - HRDF. 


EPF

According to Section 41(1) of the EPF Act 1991, an employer shall register with the EPF within 7 days from the date they become liable to contribute (when the first employee is employed) at any EPF counter. SSM-registered employers can apply online

The following documents need to be submitted:

For companies

    1. Copy of SSM Form 9

    2. Copy of SSM Form 49

    3. IC of one director

    4. KWSP Form 1 (signed and stamped)

For sole traders/partnerships

  1. Copy of SSM Form D

  2. Passport/IC of sole proprietor/partner

  3. KWSP Form 1 (signed)


SOCSO

Employers are required to register with SOCSO within 30 days from the day they start employing workers. You should first register an account with PERKESO Assist Portal. You can then register with SOCSO by completing these forms in the portal and uploading supporting documents: 


  1. Employer's Registration Form (Form 1)

  2. Employee's Registration Form (Form 2)

  3. Other Supporting Document according to your Company Type


LHDN

e-Daftar is an online application available for new taxpayers to register their tax files and receive their tax reference numbers. e-Daftar is accessible via MyTax. Employers can also register via e-Daftar and obtain their E number by selecting Employer as Type of Taxpayer in the online form. 


The following documents will need to be uploaded:

  1. Copy of SSM Form 9

  2. Copy of SSM Form 49

  3. Copy of SSM Form 13 (if company has changed name)

e-Daftar applications will be cancelled if complete documents are not received within 14 days from the date of application.


HRDF

As stipulated under Regulation 4(1) of the PSMB Act 2001, employers are required to register with HRDF from the date they are liable. The following documents should be submitted via online registration or at the PSMB counter:

For companies

    1. Copy of SSM Form 9

    2. Copy of SSM Form 24

    3. Copy of SSM Form 49

    4. Company Profile/Annual Return/Financial Statements or any documents that state the activity of the company

    5. EPF statement

    6. HRDF Form 1 and Form 1a (counter registration)

For sole traders

  1. Business License

  2. EPF statement

  3. HRDF Form 1 and form 1a (counter registration)

  4. Latest Company Profile/Annual Return/Financial Statement/Any documents that state activity of the company 


For partnerships

  1. Copy of SSM Form D

  2. EPF statement

  3. HRDF Form 1 and Form 1a (counter registration)

  4. Latest Company Profile/Annual Return/Financial Statement or any documents that state the activity of the company
